This Motor Vehicle Lease / Hire Agreement (“Agreement”) is entered into between the Lessor and the Lessee under the terms and conditions set out below.
The motor vehicle is hereby leased to the Lessee at an all-inclusive rental fee, payable on an hourly, daily, or monthly basis, as agreed between the parties.
This Agreement shall remain in force for the agreed rental period and shall expire unless renewed by the mutual written consent of both parties.
The Lessor hereby agrees:
- 3.1 To grant the Lessee exclusive use and possession of the motor vehicle during the duration of this Agreement, subject to the terms herein.
- 3.2 To keep the motor vehicle comprehensively insured with a reputable insurance company throughout the duration of this Agreement.
- 3.3 To be responsible for normal service, repairs, and fair wear and tear of the motor vehicle, and to provide a replacement vehicle where reasonably possible during service or repair.
The Lessee hereby agrees:
- 4.1 To ensure that the motor vehicle is used in a skillful and proper manner and is driven only by persons holding a valid driving license.
- 4.2 To report to the nearest police station and inform the Lessor within twenty-four (24) hours of any accident, damage, or loss of the motor vehicle (in case of self-drive).
- 4.3 In the event of an accident, whether or not the Lessee or their authorized agent is at fault, if the damage is below the insurance excess value, the cost shall be borne by the Lessee.
- 4.4 To be responsible for all costs relating to fuel, car wash, tyre punctures, parking fines, and towing expenses, including fines arising from illegal parking.
- 4.5 To ensure that the motor vehicle is used only within the territorial boundaries permitted by the Lessor.
- 4.6 Not to use the motor vehicle for any illegal activities or in contravention of the laws and regulations in force.
- 5.1 The Lessee shall have the right to terminate this Agreement in accordance with the terms agreed upon.
- 5.2 The Lessee shall not assign or transfer any obligations or rights under this Agreement to a third party, whether in whole or in part, without the prior written consent of the Lessor.
- 5.3 The Lessor shall immediately notify the Lessee of any changes in management of the Lessor’s business that may affect this Agreement.
6.1 This Agreement shall, in all respects, be governed and construed in accordance with the laws of the applicable jurisdiction.
7.1 Any dispute arising between the parties shall first be resolved by mutual discussion and agreement.
7.2 Where such resolution is not possible, the matter shall be referred to a court of competent jurisdiction.
This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or representations relating to the motor vehicle hire or lease.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement through their duly authorized representatives.
